Terms and Conditions

Please read these Terms and Conditions carefully before using the Service. They are an agreement between you and the Operator.

Interpretation and Definitions

Capitalized words have the meanings below, whether singular or plural.

Acknowledgment

By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service, and make purchases, with the permission of a parent or legal guardian who agrees to these Terms.

What the Service Does

What Should I Wear? uses artificial intelligence to show you, live on camera, what clothing from your photos might look like on you. Try-on results are AI-generated approximations. They may not accurately reflect the fit, size, color, material or look of a real garment, and you should not rely on them when deciding whether to buy clothing.

Your Account

You sign in with your Google account. You are responsible for activity on your Account and for keeping your Google account secure. Let us know right away if you believe your Account has been used without your permission.

Live Time, Purchases and Subscriptions

Your Content

You keep ownership of the Content you upload. You give us a limited, worldwide, non-exclusive, royalty-free license to use, store, process and transmit your Content, including through our AI providers, only as needed to provide the Service to you. This license ends when your Content is deleted, except where it has been shared with others or we must keep it by law.

You are responsible for your Content and confirm that you have the right to upload it.

Copyright Complaints

We respect intellectual property rights. If you believe material on the Service infringes your copyright, email hello@whatshouldiwear.io with a description of the work, where the infringing material is, your contact details, a statement that you believe in good faith the use is not authorized, a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner, and your physical or electronic signature. You may be liable for damages if you knowingly misrepresent that material is infringing.

Intellectual Property

The Service, including its design, software, name and logos but not your Content, belongs to the Operator and is protected by law. You may not copy or use them without our written permission.

Your Feedback to Us

If you send us ideas or feedback, you let us use them freely, without payment or obligation to you.

Links to Other Websites

The Service may link to websites we don't control, such as Stripe's checkout and billing pages. We are not responsible for their content or practices.

Termination

We may suspend or end your access at any time if you break these Terms. You can stop using the Service at any time, and ask us to delete your Account by email. Unused Live Time is lost when an Account is ended for breaking these Terms. If we stop offering the Service, we will give you reasonable notice.

Limitation of Liability

To the fullest extent allowed by law, the Operator's total liability to you for any claim related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. We are not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost data, or purchases you made based on a try-on result. Some places don't allow these limits, so some of them may not apply to you.

"As Is" and "As Available" Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted, error-free or secure, or that AI results will be accurate.

Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law rules. Your use of the Service may also be subject to other local, state, national or international laws.

Disputes

If you have a concern, please contact us first and we will try to resolve it informally. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Cook County, Illinois, and you and we agree to their jurisdiction.

For European Union Users

If you are a consumer in the European Union, you benefit from any mandatory provisions of the law of the country you live in, and nothing in these Terms takes those rights away.

United States Legal Compliance

You confirm that you are not located in a country subject to a US government embargo, and that you are not on any US government list of prohibited or restricted parties.

Severability and Waiver

If any part of these Terms is found unenforceable, the rest stays in effect. Not enforcing a part of these Terms is not a waiver of our right to enforce it later.

Changes to These Terms

We may update these Terms. We will post the new version here and update the date at the top. For significant changes, we will let you know by email or in the app at least 7 days before they take effect. By continuing to use the Service after changes take effect, you agree to the new Terms.
